MINUTES FOR DECEMBER 28, 2018

BOARD OF CHEROKEE COUNTY COMMISSIONERS

CHEROKEE COUNTY, KANSAS

CONVENE

Chairman Cory Moates called the regular session of the Cherokee County Board of Commissioners (The Board), to order at 8:00 a.m. on Monday, December 28, 2018 in the Commission Room, #109 of the Cherokee County Courthouse located at 110 W Maple St., Columbus, Kansas.  Commissioner Cory Moates opened the meeting with prayer followed by the Pledge of Allegiance.  Commissioners Cory Moates, Pat Collins, Neal Anderson, County Counselor Barbara Wright, and County Clerk Rodney Edmondson were present.

A motion was made by Commissioner Anderson to approve the minutes of the December 17, 2018 BOCC meeting as written.  The motion was seconded by Commissioner Collins.  The motion carried 3-0.

A motion was made by Commissioner Moates to approve the payroll for the period ending December 21, 2018.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0.

A motion was made by Commissioner Moates to approve the payroll for the period ending December 27, 2018.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0.

Clerk Edmondson presented Resolution 01-2019, a Waiver from GAAP for 2019, for a first read by the Board.  The Board placed the item on the agenda for January 7, 2019.

Clerk Edmondson presented a Corporate Application for License to Sell Cereal Malt Beverages for the Riverton Quik Stop for 2019.   Edmondson stated that the Riverton Quik Stop is on the delinquent sewer fees list and October 2017 was the last payment that they made toward their sewer costs.  Those costs in the amount of $1,034.21 have been assessed to the property taxes on that property.  As of this moment, the first half taxes that were due on December 20th have not been paid either.  Edmondson stated that the Cereal Malt Beverage Act requires that applicants be of good character and reputation in the community.

A motion was made by Commissioner Moates to deny the renewal of the CMB License to Riverton Quik Stop until they are in good standing with the County.  The motion was seconded by Commissioner Collins.  The motion carried 3-0.

Austin Ross appeared before the Board regarding court fees that are assessed on property that is on a pending tax sale list.  He has paid nearly $30,000 in back taxes on properties that he is purchasing.  He is asking for relief for the $1,800 in court fees on those properties.  He has spoken with Gene Barrett and he stated that the Commissioners would need to waive those fees.  Raven Elmore, County Treasurer, stated that she is with the understanding that the attorney must be the one that waives the fees based on conversations between Gene Barrett and the Klenda Law Firm.  She will contact Gene Barrett and ask if he will waive all or part of the court fees, then contact Ross with a decision.

Counselor Wright stated that she has draft resolutions prepared for consideration in January for the new fire districts.  The Board decided on a first read date of January 14, 2019.

A motion was made by Commissioner Collins for an executive session for the discipline of non-elected personnel with the Board, Counselor Wright, and County Appraiser Mark Hixon.  The Board will reconvene in the Commission room at 8:55 a.m.  The motion was seconded by Commissioner Moates.  The motion carried 3-0 at 8:45 a.m.

No action was taken during the executive session.

Commissioner Moates made a motion to adjourn until the next regular meeting set for Monday, January 7, 2019 at 9:00 a.m.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0 at 08:57 a.m.
