MINUTES FOR AUGUST 20, 2018

BOARD OF CHEROKEE COUNTY COMMISSIONERS

CHEROKEE COUNTY, KANSAS

CONVENE

Chairman Cory Moates called the regular session of the Cherokee County Board of Commissioners (The Board), to order at 9:00 a.m. on Monday, August 20, 2018 in the Commission Room, #109 of the Cherokee County Courthouse located at 110 W Maple St., Columbus,Kansas.  Jim Tunnell opened the meeting with prayer followed by the Pledge of Allegiance.  Commissioners Cory Moates, Pat Collins, Neal Anderson, County Counselor Barbara Wright, and County Clerk Rodney Edmondson were present.

Commissioner Moates read a thank you card from Christian Engroff thanking the Board for the opportunity to go to Fargo for a wrestling tournament.

Commissioner Moates reported that the sewer lift station in Lowell almost overflowed yesterday due to storm water infiltrating the system.

A motion was made by Commissioner Collins to approve the minutes of the August 13, 2018 BOCC meeting as written.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0.

A motion was made by Commissioner Anderson to approve the minutes of the August 17, 2018 BOCC Special Meeting for canvassing the election as written.  The motion was seconded by Commissioner Collins. The motion carried 3-0.

A motion was made by Commissioner Moates for an attorney client executive session for tax sale purposes with the Board, Counselor Wright, Rebecca Brassart from 911 Mapping, Treasurer Raven Elmore, Register of Deeds Barbara Bilke, and Clerk Edmondson for a period of 20 minutes.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0 at 9:15 a.m.

The meeting reconvened at 9:35 a.m.

A motion was made by Commissioner Collins for an attorney client executive session for tax sale purposes with the Board, Counselor Wright, Rebecca Brassart from 911 Mapping, Treasurer Raven Elmore, Register of Deeds Barbara Bilke, and Clerk Edmondson for a period of 15 minutes.  The motion was seconded by Commissioner Moates.  The motion carried 3-0 at 10:16 a.m.

The meeting reconvened at 10:31 a.m.

Commissioner Moates stated that there are major informalities, misinformation, and concerns over the method of serving notices on properties on Mr. Myers tax sale list.  Counselor Wright has checked with the court and reviewed the petition.  Moates stated that after reviewing the contract agreement between the County and Mr. Myers, it is recommended that the contract with him be terminated and he be requested not to file any more petitions.

A motion was made by Commissioner Collins to cancel the contract with Mr. Myers.  The motion was seconded by Commissioner Moates.  The motion carried 3-0.

Commissioner Moates stated that they are going to move toward a firm that specializes in tax sales.

A motion was made by Commissioner Collins for an executive session for the discipline of non-elected personnel.  The motion was seconded by Commissioner Anderson.  The motion carried 3-0 at 10:55 a.m.

The meeting reconvened at 11:05 a.m.

No action was taken during the executive session

Commissioner Anderson made a motion to adjourn until the regular meeting set for Monday, August 27, 2018 at 9:00 a.m.  The motion was seconded by Commissioner Moates.  The motion carried 3-0 at 11:07 a.m.
